The investigation looks for evidence of commitments or regular
procedures of the decision-maker. If a decision-maker makes
a commitment that a certain procedure will occur and it does
not, the decision-maker should be required to fulfil the obligation
as long as it does not interfere with a statutory duty. A breach
of legitimate expectation is rarely found but it certainly would
be reviewed. |
